Legal requirements

Below is a list of the legalities we need to tick off to get you married!

This list is not exhaustive, and you may be required to complete additional documentation based on your individual circumstances.

Paperwork

  • Notice of Intended Marriage (NOIM): Must be given to me at least one month before and no longer than 18 months prior to your ceremony. I will need to sight evidence of your date and place of birth, as well as photo ID when completing this document.
  • Declaration of No Legal Impediment to Marriage: This must be signed by both parties to the marriage in my presence prior to your wedding day. This form will be located on the back of one of the official certificates of marriage.
  • Official Certificate of Marriage x 2: These will be both completed at your ceremony after you’ve said your legal vows, and signed by both parties to the marriage, your two witnesses and myself. One of these will be sent to the state BDM, and one will be kept by me.
  • Couple’s Marriage Certificate: This will be completed at your ceremony after you’ve said your legal vows, and signed by both parties to the marriage, your two witnesses and myself. I will then give this certificate to your nominated person to look after on your wedding day.

Ceremony legalities

In order for your marriage to be solemnised, the following things must happen during your ceremony:

  1. I must recite the monitum:
    I am duly authorised by law to solemnise marriages according to law. Before you are joined in marriage in my presence and in the presence of these witnesses, I’m to remind you of the solemn and binding nature of the relationship into which you are now about to enter. Marriage, according to law in Australia, is the union of two people, to the exclusion of all others, voluntarily entered into for life.
  2. Both parties must say the following vow in the presence of at least two witnesses over the age of 18:
    I call upon the persons here present to witness that I, (name), take you, (name), to be my lawful wedded wife/husband.
  3. Both parties to the marriage, two witnesses over the age of 18 and myself must sign the 3 marriage documents detailed above.

And voilá! You’re married!
